No verdict, and no score: the Clancy jury hung, and the TrueJury forecast is void and held open
The jury in Commonwealth v. Lindsay Clancy was discharged on Friday, September 4, 2026, after seven days of deliberation, and Judge William Sullivan declared a mistrial. In its final note the jury told the court that it was unable to come to a unanimous decision and would not be able to. Reporting on the jury notes put the split at eleven to one in favor of a finding of not criminally responsible. The defense asked the court to remove the lone holdout, the court declined, and a single justice of the Supreme Judicial Court denied an emergency petition the same afternoon.
TrueJury's public forecast on the case is recorded as void and held open. It is not scored, and it will not be scored unless and until every count reaches a final disposition in the same direction. The rule requiring that was published on the case page on August 27, before the jury returned.
Thirty three members of the public read the trial record and cast a sealed forecast before the jury retired, splitting 51.5 percent for criminal responsibility against 48.5 percent for a finding of no criminal responsibility. A jury that cannot agree is, in one narrow sense, the outcome that division anticipated, and we are deliberately not claiming it as a hit. Our ballot did not offer a hung jury as an option, our jurors did not predict one, and crediting ourselves for it after the fact is the exact move our published rules exist to prevent.
The Commonwealth has not announced whether it will retry the case. Plymouth County District Attorney Timothy Cruz said on Friday that his office would make that decision at a later date. The court set September 29, 2026 for a hearing on next steps. The defendant remains held at a state psychiatric hospital.
